Please read these Terms and Conditions carefully before using the Tandemly application and related services.

Interpretation and Definitions

Interpretation

The words with an initial capital letter have meanings defined under the following conditions. These definitions apply whether they appear in singular or plural form.

Definitions

For the purposes of these Terms and Conditions:

Application means the Tandemly mobile application provided by the Company.

Application Store means the digital distribution platform through which You download the Application, including the Apple App Store or Google Play Store.

Account means a unique account created by You to access and use the Service.

Company (referred to as “the Company,” “We,” “Us,” or “Our”) refers to Tandemly.

Content means any information, materials, or content made available through the Service, including photos, profile information, biographies, messages, interests, and other information submitted by users.

Device means any device that can access the Service, including smartphones, tablets, or computers.

Feedback means suggestions, comments, ideas, or other feedback provided by You regarding the Service.

Service means the Tandemly application and any related services provided by the Company.

Subscriptions means paid access to certain features or functionality of the Service offered by the Company.

Terms and Conditions (also referred to as “Terms”) means this agreement governing Your use of the Service.

You means the individual accessing or using the Service.

Acknowledgment

These Terms and Conditions govern Your use of the Service and establish the agreement between You and Tandemly.

By accessing or using the Service, You agree to be bound by these Terms. If You do not agree with any part of these Terms, You may not access or use the Service.

You represent and warrant that You are at least 18 years old. Tandemly does not permit individuals under the age of 18 to use the Service.

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, store, and protect personal information and describes Your privacy rights.

Introduction

These Terms and Conditions (“Terms”) govern your access to and use of the Tandemly mobile application, website, and related services (collectively, the “Service”) operated by Tandemly (“Company,” “We,” “Us,” or “Our”).

By creating an account, accessing, or using the Service, You agree to be bound by these Terms and our Privacy Policy. If You do not agree with these Terms, You may not access or use the Service.

Eligibility

You must be at least 18 years old to create an account and use the Service.

By creating an account, You represent and warrant that:

You are at least 18 years old;
You have the legal capacity to enter into these Terms;
The information You provide is accurate and complete; and
Your use of the Service does not violate any applicable laws or regulations.

Tandemly reserves the right to suspend or terminate accounts that do not meet these requirements.

Creating an Account

To use certain features of the Service, You must create an account and provide certain information, including but not limited to your name, email address, phone number, date of birth, profile information, photos, and interests.

You agree to:

Provide accurate and current information;
Maintain the security of your account credentials;
Update your information when necessary; and
Be responsible for all activity occurring through your account.

You may not create an account using false information, impersonate another person, or create an account on behalf of another individual without authorization.

Using Tandemly

Tandemly is a platform designed to help users connect with other individuals based on shared interests, including fitness activities, sports, and an active lifestyle.

You understand that Tandemly does not conduct background checks on users and does not guarantee the identity, behavior, safety, or suitability of any user you interact with.

You are responsible for exercising appropriate judgment and taking reasonable precautions when communicating with or meeting other users.

User Content

The Service allows You to create profiles and submit content, including photos, biographies, interests, messages, and other information (“User Content”).

You retain ownership of the User Content You submit.

By submitting User Content to the Service, You grant Tandemly a limited, worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and process such content solely for the purpose of operating, maintaining, and improving the Service.

You represent and warrant that:

You own or have the necessary rights to submit your User Content;
Your User Content does not violate these Terms or applicable laws; and
Your User Content does not infringe upon the rights of any third party.

Acceptable Use

You agree not to use the Service to:

Harass, threaten, abuse, or harm other users;
Engage in hate speech, discrimination, or unlawful behavior;
Create fake identities or impersonate others;
Misrepresent your age, identity, or personal information;
Request money or financial assistance from other users;
Promote scams, spam, or unauthorized commercial activities;
Share illegal, harmful, or inappropriate content;
Attempt to access another user’s account or data;
Interfere with the operation or security of the Service.

Tandemly reserves the right to remove content or take action against accounts that violate these rules.

User Safety

While Tandemly encourages meaningful connections, You are solely responsible for your interactions with other users.

You should:

Protect your personal information;
Avoid sharing financial information with other users;
Use caution when communicating with people online; and
Meet other users in safe public locations when meeting offline.

Tandemly is not responsible for the actions, conduct, or behavior of users outside the Service.

Location Services

Certain features of Tandemly may require access to your location information.

Location information is collected only while You are actively using the Service and according to the permissions You provide through your device settings.

Account Suspension and Termination

You may delete your account at any time through the Service.

We reserve the right to suspend, restrict, or terminate your account if:

You violate these Terms;
You engage in harmful or abusive behavior;

Your actions create risk for other users or Tandemly.

Where permitted by applicable law, termination may result in the loss of access to your account and associated features.

Subscriptions and Payments

Certain features of Tandemly may require payment through a subscription or other paid service.

If You purchase a subscription:

You agree to pay all applicable fees;
Payments will be processed through the applicable app store or payment provider;
Subscriptions may automatically renew unless canceled according to the applicable platform rules; and
Cancellation and refund requests are subject to the policies of Apple App Store, Google Play, or the applicable payment provider.

Prices and subscription features may change from time to time. Any changes will be communicated as required by applicable law.

Privacy and Personal Data

Your privacy is important to us.

Our collection, use, storage, and protection of personal information is described in our Privacy Policy.

The Privacy Policy explains:

What personal information we collect;
How we use personal information;
How we protect personal information;
Your rights regarding your personal information; and
How you may request access, correction, or deletion of your information.

By using Tandemly, You acknowledge that You have reviewed our Privacy Policy.

Intellectual Property

The Service, including its design, features, software, branding, logos, text, graphics, and other materials, is owned by or licensed to Tandemly and is protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or exploit any part of the Service without our prior written permission.

Third-Party Services

The Service may rely on third-party services, including analytics, advertising, hosting, and security providers.

Your use of the Service may also be subject to the terms and policies of those third-party providers.

Disclaimer

The Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, Tandemly does not guarantee that:

The Service will always be available;
The Service will be error-free;
Users will find compatible matches or relationships; or
User information or behavior will always be accurate.

Limitation of Liability

To the maximum extent permitted by applicable law, Tandemly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Nothing in these Terms limits any rights or protections that cannot be excluded under applicable law.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the United States and the State of [Insert State], without limiting any mandatory rights You may have under the laws of your country of residence.

Changes to These Terms

We may update these Terms from time to time.

If material changes are made, we will provide notice as required by applicable law.

Your continued use of the Service after changes become effective means You accept the updated Terms.

Subscriptions

Certain features of Tandemly may require a paid subscription (“Subscription”).

Subscription Billing and Renewal

If You purchase a Subscription, payment will be processed through the applicable Application Store, including the Apple App Store or Google Play Store, depending on the device You use.

Your Subscription will automatically renew unless You cancel it before the end of the current Subscription period.

The renewal period and Subscription price will be displayed before purchase.

Subscription Cancellation

You may cancel your Subscription renewal at any time through your Application Store account settings.

For subscriptions purchased through:

Apple App Store: cancellation must be managed through your Apple account settings.
Google Play Store: cancellation must be managed through your Google Play account settings.

Canceling a Subscription prevents future charges. You will continue to have access to Subscription features until the end of your current paid Subscription period.

Subscription Fees and Changes

Tandemly may change Subscription prices or features from time to time.

If Subscription fees change, You will be notified through the applicable Application Store before the change takes effect. Continued use of Subscription features after the price change becomes effective means You accept the updated Subscription fee.

Refunds

Subscription payments are processed through the applicable Application Store.

Refund requests are handled according to the refund policies of Apple, Google, or the applicable payment provider.

Nothing in these Terms limits any refund rights You may have under applicable consumer protection laws.

Free Trials

Tandemly may offer free trials or promotional Subscription periods from time to time.

If You start a free trial that converts into a paid Subscription, You will be charged the applicable Subscription fee unless You cancel before the trial period ends.

The terms of any free trial, including duration and pricing after the trial period, will be displayed before You start the trial.

User Accounts

When You create an account with Tandemly, You must provide information that is accurate, complete, and current.

You are responsible for maintaining the accuracy of your account information. Providing false, misleading, or incomplete information may result in suspension or termination of your account.

User Content

Tandemly allows users to create profiles and submit content, including photos, biographies, interests, messages, and other information (“User Content”).

You remain the owner of the User Content You submit.

By submitting User Content through the Service, You grant Tandemly a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and process such content only as necessary to operate, maintain, improve, and provide the Service.

You represent and warrant that:

You own or have the necessary rights to submit your User Content;
Your User Content does not violate these Terms or applicable laws; and
Your User Content does not infringe upon the rights of any other person.

Content Restrictions

You may not upload, post, send, or share Content that:

Is unlawful, harmful, threatening, abusive, harassing, or discriminatory;
Contains hate speech or promotes violence;
Impersonates another person or creates a misleading identity;
Contains false or misleading information intended to deceive other users;
Promotes scams, fraud, spam, or unauthorized advertising;
Contains sexually explicit, exploitative, or inappropriate material;
Violates another person’s privacy, intellectual property rights, or other legal rights; or
Attempts to interfere with the security, operation, or functionality of the Service.

Tandemly reserves the right to review, remove, restrict, or disable access to Content that violates these Terms or creates a risk to users or the Service.

Intellectual Property

The Tandemly Service, including its software, design, features, branding, logos, trademarks, and other original materials, is owned by or licensed to Tandemly.

You may not copy, modify, distribute, sell, reverse engineer, or use any part of the Service without prior written permission from Tandemly.

Third-Party Services

The Service may contain links to third-party websites, services, or applications.

Tandemly does not control and is not responsible for third-party services, including their content, privacy practices, availability, or terms.

We encourage You to review the terms and privacy policies of any third-party services You access.

Account Suspension and Termination

We may suspend, restrict, or terminate your account if You:

Violate these Terms;
Provide false, inaccurate, or misleading information;
Misuse the Service;
Harm, threaten, or harass other users;
Engage in unlawful activity; or
Create risk or harm to Tandemly, our users, or third parties.

You may delete your account at any time through the Service or stop using the Service.

Upon termination, your right to access and use the Service will end.

Disclaimer

Tandemly provides the Service on an “as available” and “as is” basis.

To the maximum extent permitted by applicable law, Tandemly does not guarantee that:

The Service will always be available or uninterrupted;
User information will always be accurate or complete;
You will find compatible matches, friendships, or relationships; or
Interactions with other users will always be safe, appropriate, or successful.

You are responsible for your own decisions, safety, and interactions with other users.

Limitation of Liability

To the maximum extent permitted by applicable law, Tandemly and its affiliates, partners, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

Nothing in these Terms limits any rights or protections that cannot be excluded or limited under applicable law, including mandatory consumer protection rights available to users in certain jurisdictions.

Governing Law

These Terms are governed by and interpreted in accordance with the laws of the United States and the State of [Insert State], without limiting any mandatory rights You may have under applicable consumer protection laws in Your country of residence.

Dispute Resolution

If You have any concerns or disputes regarding the Service, You agree to first contact Tandemly so we can attempt to resolve the matter informally.

European Union Users

If You are located in the European Union, You may benefit from mandatory consumer protection rights provided under the laws of Your country of residence.

Nothing in these Terms affects those rights.

Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights or provisions.

Translation Interpretation

These Terms may be translated into other languages for Your convenience.

In the event of any conflict or inconsistency between the English version and a translated version, the English version will control.

Changes to These Terms

We reserve the right to modify or update these Terms at any time.

If we make material changes, we will provide notice as required by applicable law.

By continuing to access or use the Service after updated Terms become effective, You agree to be bound by the revised Terms.
